New York City is set to ban student-facing AI from 2-K through eighth grade
New York City Public Schools is expected to bar student-facing generative AI from 2-K through eighth grade and recommend 30 to 45 minute screen-time limits.

New York City Public Schools is expected to publish its final artificial intelligence policy on Wednesday 2 September 2026, and the NYC schools AI ban it contains would remove generative AI tools from every grade below high school. Chalkbeat New York reported the contents on 1 September, citing four people briefed on the plans and Education Department documents it obtained, after the New York Daily News broke the story the same day. The department’s public guidance page still showed the March 2026 draft as this article was written, although its page title had already been changed to “Guidance on Artificial Intelligence and Screen Time”.
The reach is unusual for a district AI rule. New York City Public Schools enrolled 906,248 students across 1,597 schools in 2024-25, making it the largest school system in the United States. Gothamist, reporting from the same presentation, put the number of children covered by the ban at about 600,000, or two-thirds of students.
What the NYC schools AI ban covers
Students from 2-K through eighth grade would not have access to generative AI, including chatbots and AI tutors. Gothamist describes the measure as a one-year pause on all student use of artificial intelligence through eighth grade rather than a permanent ban, and Chalkbeat describes it as a ban; the two accounts draw on the same internal documents and have not been reconciled publicly.
Separately, the guidelines bar schools from giving individual devices to pupils from preschool through second grade, though classrooms will still be allowed to have smart boards. For older primary and middle school pupils the policy recommends screen-time limits on individual devices of 30 minutes for grades 3 to 5 and 45 minutes for middle school students. Chalkbeat presents these as recommendations that depend on subject matter and school approach, and does not state the period they cover; Gothamist describes them as time limits. Neither report specifies whether the minutes are daily or per lesson.
The exceptions are narrow and practical. Regular reading and maths assessments that pupils complete on computers continue, as does assistive technology for students with disabilities and tools for English language learners. Gothamist adds carve-outs for e-books, coding assignments and robotics.

What teachers may and may not do
Teachers keep access, with conditions. The presentation allows approved AI tools for instructional tasks such as lesson planning, translation and drafting communications. It does not allow them for grading, behaviour monitoring, counselling or developing special education plans. Gothamist’s account of the prohibitions lists grading, crisis management and decisions about graduation or promotion, so the two published lists overlap without matching.
Those limits track the “red light” list already published in the March 2026 draft, which is public on the department’s guidance page. That document states that “Placement, discipline, eligibility, promotion, graduation, and program access require qualified human decision-making”, that “All special education documents are developed by qualified professionals”, that “Behavioral monitoring and student surveillance are prohibited”, and that “Student data will not train AI models, be sold, or be used to make money”.
For high school the department’s rationale, quoted from the presentation, is that “students need guided preparation for a world and economy increasingly driven by AI and new technologies”. Chalkbeat, citing the Daily News, reports five pilot programmes at an unspecified number of schools. No schools have been named and the content of the pilots has not been described.
The union is not persuaded that the line holds. Michael Mulgrew, president of the United Federation of Teachers, said on 1 September: “How are we banning AI in a high school? The students are using it anyway. It’s embedded in so many platforms now.”
How the policy got here
The department released preliminary guidance on 24 March 2026 and ran a 45-day public comment period that closed on 8 May. Officials reported more than 6,000 comments, 48 per cent from educators and 42 per cent from parents; First Deputy Chancellor Danielle Giunta later cited nearly 6,500 at a City Council hearing. A final playbook was promised for June. On 24 June the department told the Council it would slip to later in the summer, with Giunta pointing to a “shifting national conversation, which has really escalated over just the last couple of weeks alone”. Chalkbeat puts the delay at about two months.

The Council letter is the clearest measure of the pressure. Signed on 9 June 2026 by 29 of the Council’s 51 members, including Technology Committee chair Carmen De La Rosa, it opens: “We ask that you immediately pause the use of Generative Artificial Intelligence in our schools.” It calls the department’s draft flawed and asks the city to hold off “until rigorous guardrails can be developed with public and expert input”.
Alongside it, the software purchasing pause has been running since early July, when Chancellor Kamar Samuels asked principals to hold off on educational software purchases pending the policy. It covers all educational software purchase orders, including products with no AI component such as electronic gradebooks, family communication platforms and digital hall passes, with an exemption for mandated services and school opening needs. Winss reported on its effects in the NYC schools AI policy delay that froze software buying. None of the 1 and 2 September reports says whether the freeze lifts with the policy.
Where this sits nationally
No other large US district has been confirmed as banning student-facing generative AI in elementary grades, which makes New York City the first at this scale. Los Angeles Unified, the second-largest district, approved a resolution on 21 April 2026 to create a policy limiting or banning technology by grade level from the 2026-27 school year, but that measure addresses education technology and screens rather than generative AI specifically.
The wider policy layer is guidance rather than prohibition. As of October 2025, 34 states and Puerto Rico had released AI guidance for schools, according to AI for Education. New laws in Idaho, Maryland, Oklahoma and Virginia now require districts to adopt AI policies, following earlier mandates in Ohio and Tennessee; Oklahoma’s law prohibits AI tools from being used primarily for grading, discipline or other high-stakes educational decisions. Federal-level direction is set out in the US education technology guidance issued for schools, and the arguments made to legislators are covered in the Senate hearing that urged guardrails and training for AI in schools. New York State has already seen a smaller retreat, reported in the school that paused its AI classroom robot pilot after concerns.

New York City Public Schools is the largest school district in the United States, with 906,248 students and 1,597 schools in 2024-25, alongside 281 charter schools enrolling 148,089 students. English language learners made up 16.8 per cent of enrolment, students with disabilities 22.4 per cent, and economically disadvantaged students 75.3 per cent. The proposed Fiscal 2027 budget for the department is 37.92 billion US dollars, or 30.5 per cent of the city’s proposed budget, according to the City Council Finance Division.
The district’s position on generative AI has moved twice. It blocked ChatGPT on department devices and networks on 3 January 2023, citing concerns about student learning and about the safety and accuracy of content. Then-Chancellor David C. Banks announced the reversal in a Chalkbeat op-ed on 18 May 2023, writing that “The knee-jerk fear and risk overlooked the potential of generative AI”. Governance built up afterwards, including an enterprise privacy and security review process created in 2023, AI-specific vendor standards added in December 2024, a central AI task force of 76 members, and an external AI advisory council appointed under Banks. Kamar Samuels became chancellor in January 2026 under Mayor Zohran Mamdani, and the policy expected this week is the first full rewrite of the district’s AI rules since the 2023 reversal.
